Deep Etch Games respects your privacy and is committed to protecting your personal data. This privacy policy aims to give you information about how Deep Etch Games collects and processes your personal data through your use of our website. This includes any data you may provide through our website when you sign up to our newsletter or contact us or when you buy our products, play games published by us, take part in competitions arranged by us or other interactions with Deep Etch Games. 

Our website is not intended for children and we do not knowingly collect data relating to children.

2. The data we collect about you

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows (and these words are used throughout or privacy policy):

  • Identity Data includes first name, last name, username or similar identifier, title, age or date of birth and gender.
  • Contact Data includes, email address and telephone numbers and, depending on the use in question, a physical address.
  • Transaction Data, if appropriate, includes details of our games and services you have purchased through third parties.
  • Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access our website or games. 
  • Game Data includes username, games played, scores achieved, leader board rankings, game metrics, achievements, forum interactions and similar information. 
  • Profile Data includes your interests (including, for example, the nature of games played), feedback and survey responses and should we introduce any login functionality on our website, username and password.  
  • Usage Data includes information about how you use our website, our games and products and services. 
  • Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.

The collection of Game Data will require a player to first agree to have such data collected by us through the enabling of such functionality. This will be required for any problem solving, should a player contact us for issues within a game. Usernames may be readily and publicly visible on forums. 

Any Technical Data generated from Game Data will be anonymised, as will any time played data and so will not be attributed to any individual.

We may also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website or game feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you or where we are trying to assist you in any problem solving, and you fail to provide that data when requested, we may not be able to perform the contract we have with you (if any) or to carry out the other services we may be trying to complete for you. In this case, we may have to cancel or not complete the service we are trying to perform for you. We will notify you if this is the case at the time.

3. How is your personal data collected?

We use different methods to collect data from and about you including through:

  • Direct interactions. You may give us your Identity Data and Contact Data by filling in forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:
    • create an account on our website, should we introduce such a function;

  • Automated technologies or interactions. If you enable the collection of Game Data within our games, you may provide us with Identity, Game Data, Transaction Data and Usage Data. As you interact with our website, we will automatically collect Technical Data about your equipment, browsing actions and patterns.   • Third parties or publicly available sources. We will receive personal data about you from various third parties as set out below:
    • Technical Data from the following parties;

a)  analytics providers such as Google based outside the EU;

b)  Ionos, our website platform, which may be based outside the EU.

  • Identity and Contact Data from our email marketing platform provider, Ionos, which may be based outside the EU.

4. How we use your personal data

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the service we would like to perform for you or any contract we are about to enter into or have entered into with you.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  • Where we need to comply with a legal obligation.

The Glossary below sets out more about the types of lawful basis that we will rely on to process your personal data. 

Generally, we do not rely on consent as a legal basis for processing your personal data although we will get your consent before sending any third party direct marketing communications to you via email or text message. You have the right to withdraw consent to marketing at any time by contacting us.

Purposes for which we will use your personal data

We have set out below, in a table format, a description of all the ways we plan to use your personal data, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate.

Note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data. Marketing 

We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising. We provide the following personal data control mechanisms:

Promotional offers from us

We may use your Identity, Contact, Technical, Game (if enabled), Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which services and offers may be relevant for you (we call this marketing). 

You will receive marketing communications from us if you have requested information from us or purchased games, products or services from us and provided your contact details as part of that process and you have not opted out of receiving that marketing.

Third-party marketing 

We will get your express opt-in consent before we share your personal data with any third party for marketing purposes. 

Opting out

You can ask us or third parties to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you. 

Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a product or service experience that you may have requested or that we may have provided or other such interactions.

If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

5. Disclosures of your personal data

We may share your personal data with the parties set out below for the purposes set out in the table above.

  • External Third Parties as set out in the Glossary.
  • Specific third parties such as our marketing communications provider.
  • Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

6. International transfers

Some of our external third parties are based outside the EEA so their processing of your personal data will involve a transfer of data outside the EEA. 

Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented: 

  • We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission.
  • Where we use certain service providers, we may use specific contracts approved by the European Commission which give personal data the same protection it has in Europe.
  • Where we use providers based in the US, we may transfer data to them if they are part of the Privacy Shield scheme which requires them to provide similar protection to personal data shared between Europe and the US. Our website platform and marketing communications provider is a participant in the Privacy Shield scheme.

7. Data security 

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality. 

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

8. Data retention

How long will you use my personal data for?

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

9. Your legal rights

Under certain circumstances, you have rights under data protection laws in relation to your personal data. These are set out under “Your Legal Rights” below.

No fee usually required

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repeated or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated. 

10. Uploading User Generated Content

When uploading User Generated Content (UGC) to our website you must not:

  • infringe or use any trademarked images or brands
  • use offensive, defamatory images or text

Using any of the above means your creation may be removed and you may be held liable.

11. Glossary 

LAWFUL BASIS

Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service or products and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). You can obtain further information about how we assess our legitimate interests against any potential impact on you in respect of specific activities by contacting us.

Performance of Contract means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.

Comply with a legal obligation means processing your personal data where it is necessary for compliance with a legal obligation that we are subject to.

THIRD PARTIES

External Third Parties

  • Service providers acting as processors who provide IT, game, forum and other system administration services, whether in conjunction with our games or marketing or otherwise.
  • If appropriate, those businesses from whom we licence our game titles.
  • Professional advisers acting as processors or joint controllers including lawyers, accountants and insurers based most likely in the United Kingdom (but also in any other country that may be relevant to the issue in question) who provide consultancy, legal, insurance and accounting services.
  • HM Revenue & Customs, regulators and other appropriate authorities acting as processors or joint controllers based in the United Kingdom who require reporting of processing activities in certain circumstances including where suitably serious breaches of any game or forum code of conduct has arisen.

YOUR LEGAL RIGHTS

You have the right to:

Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request. 

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent.     • If defective digital content that we have supplied, damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. Which country's laws apply to any disputes?

If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland. Other rules will apply if you are accessing our sites from outside the United Kingdom.

DEEP ETCH GAMES CODE OF CONDUCT

 

Code of Conduct for community, social media, in-game and in-forum activities 

Deep Etch Games wants its community to enjoy and look forward to playing its games. The best way to achieve this is for the community to look after each other and, for that, we need rules for everyone to follow. 

The Code of Conduct (“Code”) that we have set for forums connected to our games is set out below. By participating in a forum through any platform, you are confirming that you have read and understood the terms of this Code od Conduct and also that you will follow the Code. 

The community administrators at Deep Etch Games can gather relevant information which, if necessary, can be used to identify any community members responsible for infringing any of the rules. We can do this if we ourselves come across inappropriate behaviour or if such is reported to us. Deep Etch Games reserves the right to carry out any of the following, all at its sole discretion: 

  • To give a warning as to bad conduct, seek the removal of posts, suspensions from accessing a game or a forum for a period or to permanently ban a player from access to our games or forum facilities and, in case of a suspension or ban, without having to give reasons and without needing to give prior warning. 
  • We may inform appropriate authorities if the circumstances call for it. We may take action through and in conjunction with the co-operation of any platform.
  • Continued access to and use of any forum facilities cannot be demanded or insisted upon and access remains subject to abiding by the Code and general good conduct.

If there is any event that occurs that is not covered by the Code but otherwise appears to be against the spirit of the Code, Deep Etch Games will consider the facts available to it and will make a decision at its sole discretion.

Deep Etch Games reserves the right to alter and add to this Code in any way it considers appropriate and without needing to give notice to the community.

Content of posts 

Players have come to play a particular game and to immerse themselves in that game and to enjoy their time with other players. Please keep the content of posts related to the game in question. 

You should not use posts to tell inappropriate jokes (that includes about racism, gender, illnesses, “adult” themes and so on) nor should you discuss real-world religious or political issues as we consider that they are inappropriate for our games.

You should not create any content within a forum that may be advertising anything that is not related to the game or any game that is not a Deep Etch Games game. You are not to post any links to websites other than to a Deep Etch Games website. 

We ask that you use English in a forum. Use of other languages may result in a suspension as we need to understand the content and context of what is said with regard to abiding by the Code. 

Don’t forget that use of capitals online is seen as shouting. Please use capitals sparingly and appropriately (for example, in abbreviations). If we see unnecessary or prolonged use of capitals, this may lead to us taking action in a way that we consider appropriate.

You should not include any content which is a copy of or recreates any communications with, to or between you and Deep Etch Games or any community participant, even if it is about you. Communications between Deep Etch Games staff and any participant are private and may be confidential. Please do not use the forum to make public any contact details of any Deep Etch Games staff or to discuss any contact being made direct between you and Deep Etch Games. Any game support enquiries should be directed to info@deepetchgames.com. 

We reserve the right to ask any platform to remove posts if the content of the posts may be inappropriate, having regard to the age rating for a game and the possibility that young people may be in the forum. 

We want you to stay safe so please avoid giving out any real-world information about yourself in a public forum and that includes name, address, email address, telephone numbers, etc. Deep Etch Games cannot be responsible for any situation that arises as a result of you giving out real-world contact information.

Cyber-bullying, malicious content and trolling 

Forums relating to our games should be a safe place. Consequently, any form of cyber bullying, harassment or the carrying out of any threatening behaviour by any means (or any similar activity) is strictly forbidden. This includes any behaviour or posts that could be seen to be threatening, abusive or which may be considered to invade another's privacy, or which causes annoyance, inconvenience or needless anxiety to others. In short, any activity which may upset, embarrass, alarm or annoy any other player may be in breach of the Code. 

We take this very seriously and reserve the right to apply a permanent ban if such a situation occurs.

We will not accept any posts that might contain malicious content or, for example, racism of any nature. We will take immediate and appropriate action against any breach of this rule (which may include the removal of such posts and, if we consider it appropriate, involving the appropriate authorities. 

You should also ensure that your posts do not contain anything that could be seen as discriminating against minority groups or against anyone who may have physical or mental impairments or other vulnerable persons. 

You should not make any posts that are to deliberately prompt a negative reaction or anger from a community participant. We know that this may be difficult to judge but we reserve the right to review past posts from any community participant to see if there is a pattern to their behaviour and postings and to take appropriate action. 

Competitions in a forum 

We do not expect any competition for prizes to be offered or carried out between participants and any competition that may be offered, unless it is official and offered by Deep Etch Games, is not endorsed by us. If any competition is offered by any community member, participation in that competition is at your own risk and Deep Etch Games does not accept any responsibility for or liability regarding the outcome of the competition. 

Any official competitions by Deep Etch Games would be carried out outside of a forum and so any competition within a forum that anyone is promoting will not be official unless Deep Etch Games is separately running the same competition. 

Promoting exploits, hacks or similar 

We want our games to be played in the way that they are intended to be played. 

As such, any promotion of or encouragement to make use of any software that may assist a player in exploiting any flaws in the game or, where appropriate, software error, bug and the like or any exploit that might take advantage of any code error is forbidden.  

Multiple accounts 

We consider that running multiple accounts with the intention of creating an advantage over other players is inappropriate and unfair. Account creation for the use of cheating or exploiting game mechanics may be monitored.

Illegal activities 

You should not use a forum for promoting or discussing illegal activity in any legal jurisdiction and the discussion of any activities which might be classed as illegal is strictly forbidden. If any such activities come to our attention, we may ask the relevant platform to intervene and to remove any relevant posts and we reserve the right to involve appropriate authorities.

Obscene content 

Any postings which contain any obscene or offensive content or links to obscene or offensive content are strictly forbidden and, where a game’s age-rating might include younger players, any posts you make in such a forum must be suitable for reading by any age. Any violation of this will result in the content being removed, suspensions or bans and we reserve the right to involve the appropriate authorities.

Complaints about any action taken 

Any decisions and actions we may take are ours to make and whilst we will not take any action lightly, we can make them at our sole discretion. As such, we will not accept any complaints about warnings, suspensions or bans that we may make and any such complaints may themselves result in us taking action.
